(Washington, DC) – The NFL is asking the Supreme Court to take up a dispute over who has the authority to regulate prediction markets. The NFL argues that wagers should fall under state gambling laws. The league filed the request as part of a dispute between Kalshi and the state of New Jersey, which produced conflicting decisions at the appellate level. Kalshi and other prediction markets argue that the wagers they offer are known as “swaps” and are federally regulated by the Commodity Futures Trading Commission. States, however, view this as gambling and say it should fall under their jurisdiction.
